1. Purpose of the Terms

These Terms of Use ("Terms") define the rules governing access to and use of Clickeat ("the Platform"). They describe the rights and obligations of users.

2. Acceptance of the Terms

By using the Platform, the user acknowledges that they have read and accepted these Terms without reservation.

3. Role of the Platform

Clickeat acts solely as an intermediary platform, connecting users with partner establishments (sandwich shops, bakeries, butcher shops, etc.) to allow online ordering and payment, followed by in-store pickup.

Clickeat does not sell any products and is not responsible for order preparation, quality, freshness, availability, allergens, food safety requirements, or delays, errors, or issues during pickup. Clickeat only provides technical services for ordering and payments.

4. Account creation

Certain features require a user account. The user must provide accurate and updated information and is responsible for keeping their login credentials confidential.

5. Use of the Platform

The user agrees to use the Platform in compliance with applicable laws and these Terms.

It is strictly prohibited to:

• use the Platform for fraudulent or illegal purposes;
• disrupt or attempt to disrupt the Platform’s operation;
• bypass or attempt to bypass security systems;
• scrape, extract, or collect data using automated tools (robots, crawlers, scripts);
• impersonate another person.

6. Orders and transactions

Orders placed via Clickeat are transmitted to partner establishments. All commercial aspects (pricing, availability, preparation, quality, cancellation, pickup) are the sole responsibility of the partner establishment. Clickeat cannot be held liable for issues related to the products or their preparation.

7. Payments

Payments are processed through Stripe, a secure payment provider. Clickeat collects funds on behalf of partner establishments. Clickeat does not determine product prices, does not charge additional fees to end-users, and only manages the technical payment interface.

8. Intellectual property

All elements of the Platform (text, logos, images, layout, code) are protected by intellectual property laws and remain the exclusive property of Clickeat or its partners.

9. Liability

Liability of Clickeat

Clickeat is responsible for the technical operation of the Platform, the security of payment processing, and correct transmission of orders. Clickeat is not responsible for temporary downtime, bugs, or service interruptions, or network/hosting issues outside its control.

Liability of the user

The user is responsible for providing accurate information, complying with these Terms, and all activities carried out through their account.

10. Suspension and termination of accounts

Clickeat may suspend or delete an account in case of violation of the Terms, fraudulent or suspicious activity, or misuse of the Platform.

11. Personal data protection

Personal data is processed in accordance with the Privacy Policy (GDPR) available on the Platform.

12. External links

The Platform may contain links to third-party websites. Clickeat is not responsible for their content or operation.

13. Amendments to the Terms

Clickeat may modify these Terms at any time. Users will be informed via the Platform.

14. Governing law and jurisdiction

These Terms are governed by Belgian law. Any dispute will fall under the jurisdiction of the courts of [Your region].
